購入後のNFTのご利用について
カフェノマのNFTアートは、著作権という法律にまもられたデジタルアートです。NFTご購入後も、著作権自体は譲渡されませんのでお気をつけください。
また、リアルなアートと違い、「物」ではないNFTアートには、「所有する」という法律上の決まりがありません（所有権と呼びます）。所有権が発生しないため、そもそも所有権の移転（譲渡権と呼びます）もありません。
現在の日本の法律をふまえると、NFTの購入とは「物ではないデジタルアートに、作品の保有者の履歴がブロックチェーンに記録された」という意味合いになります。
これらのことをふまえ、カフェノマとしては、以下の点にご留意いただければと考えています。
1)複製しても大丈夫？
複製権と呼ばれています。個人で鑑賞する場合など、非営利なご利用であれば問題ありません。画像を印刷したり、SNSのプロフィール画像に利用いただけます。
2)加工しても大丈夫？
翻案権と呼ばれています。加工はご遠慮ください。
3)SNSでシェアできる？
4)展示しても大丈夫？
展示権と呼ばれています。「物」ではないNFTには、そもそも権利としての展示権は及びませんが、営利目的にて展示する場合は、一度、ご相談ください。なお、展示の目的が広告にあたる場合、また、公序良俗に反した内容や法令違反、わいせつ表現にあたる場合はご利用をあらかじめ禁止させていただきます。
5)転売して大丈夫？
OpenSeaなどのマーケットプレイスで転売していただけます。
6)他人にプレゼントしても大丈夫？
もちろんです！
なお、著作権のひとつである「公衆送信権」を、ひきつづきカフェノマが保有することになります。したがいまして、転売した場合を含め、ご本人以外の第三者がオーナーとなり、これまで述べてきた「個人的な複製」や「SNSでのシェア」などはできなくなりますのでお気をつけください。

Use of NFT after purchase
Please note that the following information is based on the Japanese Civil Code.
Please note that the copyright of cafenoma's NFT art is a digital artwork protected by copyright law and is not transferred after the NFT purchase.
Also, unlike real art, NFT art is not a "thing" and there is no legal requirement to "own" it (called "ownership"). Since ownership does not occur, there is no transfer of ownership in the first place.
In light of current Japanese law, the purchase of an NFT means "a digital artwork, which is not a physical object, with the history of the work's owner recorded in the blockchain.
In light of the above, we would like to ask you to keep the following points in mind.
1) Is it safe to reproduce?
This is called the right of reproduction. It is fine for non-commercial use, such as for personal viewing. You can print the image or use it as a profile image on social networking sites.
2) Is it ok to modify the image?
This is called the right of adaptation. Please refrain from processing.
3) Can I share the images on SNS?
It is called the right of public transmission. You can share it as a "digital collectible" on Instagram! Please see the Instagram help section below for instructions on how to use this service.
In addition, there is no problem to retweet or repost cafenoma posts. Plus, you can use it as your profile picture on all social networking service, not just Instagram!
4) Is it safe to display?
It is called the right to exhibit. However, if you wish to exhibit your work for commercial purposes, please consult with us. Please note that if the purpose of the exhibition is to advertise, or if the content is offensive to public order and morals, against the law, or obscene, we will prohibit the use of the NFT in advance.
5) Is it safe to resell?
Yes, you can resell them on marketplaces such as OpenSea.
6) Is it safe to give them as gifts to others?
Of course! Please note that Cafenoma will continue to own the "public transmission rights," which is one of the copyrights. Therefore, please be aware that you will not be able to make personal copies or share them on social networking services, including resale.
